Sump Pump Requirements

Closed system sump pumps are found all over the City of Laguna Beach. They typically pump underground structure sub-drains, elevator shafts and basements of excess groundwater and condensation. The NPDES Municipal Storm Water Permit categorizes ground water discharges to the storm system as exempt discharges, meaning that it is legal and acceptable to connect closed ground water sump pump systems to the storm drain system.

HOWEVER - it is illegal to introduce pollutants to the storm drain system. This provision means that if sump pump discharges contain pollutants, they are ILLEGAL.

The burdon of proof for the lack of pollutants in sump pump discharges is on the owner of the subject property. The law requires that all pollutant-carrying discharges be treated to the Maximum Extent Practicable (MEP) prior to discharge. Property owners must submit plans showing their discharge treatment plan or a compelling reason for exemption from the policy prior to discharging to the storm drain. Final judgement of MEP lies with the City.

Many sump pumps have been connected to the storm drains for long periods of time. Upon failure, repair or replacement of any component, or a redesign of the sump pump system, treatment plans must be approved by the Water Quality Department prior to continued discharge.

Any person or business who must pump out a sump or vault for any reason using a temporary pump or syphon to the storm drain must demonstrate that the discharge is being treated to the MEP, or has been tested and determined not to carry pollutants.
