What does the new food packaging ordinance say?
Beginning July 1, 2008, Laguna Beach food vendors may no longer distribute disposal food service ware made from expanded polystyrene foam or non-recyclable plastic.

Who has to follow the Ordinance?
All retail food establishments and food vendors operating in Laguna Beach, including restaurants, delis, fast food establishments, catering trucks, vendors and fairs, and all city facilities.

What are alternatives to polystyrene foam?
Paper products, recyclable plastics, and aluminum foil food service ware.

What is wrong with polystyrene foam?
Polystyrene foam is made from crude oil, and as such is non-renewable, non-biodegradable, and virtually non-recyclable. It ends up in landfills, waterways, and the ocean. It breaks down into a small pieces and is often mistaken for food and ingested by marine birds, mammals and fish.

Are there exceptions to these requirements?
Yes, the City may exempt a food vendor or retail food vendors for up to one year -upon demonstrating the Ordinance requirements will create an “undue hardship.” An example of an undue hardship would be a situation in which no reasonably feasible, available alternative exists to a specific and necessary expanded or non-recyclable plastic food disposal service ware exists.  

What are the penalties for non-compliance?
The City will issue a written warning upon first discovery of a violation. First violation after written warning- $100; second violation- $200 fine; third and all subsequent violations thereafter- $500. Fines are cumulative and each day that a violation occurs shall constitute a separate violation.

Where can I purchase alternative food service ware products?
Ask your current supplier to offer products that meet the City’s new requirements.
