WHY DO I NEED TO BE A CONTRACT INSTRUCTOR?
LBMC 18.04.018: Business on City Property
No person shall in any manner while on city property, including beaches and parks, sell any product or service or engage in any other business or commercial activity without obtaining a business license and the prior written approval of the city manager, or duly authorized representative; provided, however, that this section does not apply to any concession operated under authority granted by the city council, nor to any other activity specifically authorized, regulated, or exempted by order or resolution of the city council.
For purposes of this section, the word "business" means and includes "business," "profession," "trade," "calling," "occupation," "show," "exhibition" or "game," and all and every kind of calling carried on for profit or livelihood whether or not a profit or livelihood is actually earned thereby and whether or not said business has a fixed place of business in the city.
WHY DO I NEED A BUSINESS LICENSE?

It is unlawful for any person, whether as principal or agent, clerk or employee, either for him or herself or for any other person, or for any body corporate, or as an officer of any corporation, or otherwise, to commence or carry on any business, profession, trade, calling, occupation, show, exhibition or game, in this chapter specified, in this city, without first having procured a license from the city so to do, or without complying with any and all regulations of such business, profession, trade, calling, occupation, show, exhibition or game, contained in this chapter.
WHAT IF MY CLASS IS “DONATION BASED?”
LBMC 5.20.020: Charitable Solicitations
It is unlawful to solicit contributions for any charitable purpose within the city without a permit from the city manager authorizing such solicitation; provided, however, that the provisions of this section shall not apply to any person organized and operated wholly or partially for charitable purposes and not operated for the pecuniary profit of any person if the solicitations by such person are conducted only among the members thereof by other members or officers thereof, voluntarily and without remuneration for making such solicitations, or if the solicitations are in the form of collections or contributions at the regular assemblies or meetings of any such person; provided, further, that when a permit has been issued to any person as defined in Section 5.20.010, other than an individual, then the individual agents and solicitors for such person shall not be required to obtain individual permits.
WHAT ABOUT MY SPORTS TEAM’S PRACTICE?
LBMC 18.28.025: Organized Play – Permit Required
No person shall participate in any organized play on any park, soccer field, baseball field, tennis/pickleball courts, sand volleyball court, pool or other recreational facility owned, operated, or controlled by the city without first receiving a permit issued by the city which authorizes the organized play at the particular site.
In determining whether or not to issue a permit, the city manager, or designee, shall consider the following and any other factors he or she deems relevant:
- The suitability of the particular facility for the proposed play.
- The effect of the activity on the neighborhood.
- The limitation on the availability of the facility for spontaneous recreational use by the public caused by the permitted use of the facility.
- Priority shall be given to groups composed of residents of the city.
The city manager, or designee, may place reasonable conditions on the issuance of a permit as he or she deems necessary and proper to protect the public welfare, including, but not limited to:
- Restrictions on the number, age and other designations of persons who may participate in such permitted play.
- Restrictions on the season, days of the week and time of day that the particular facility may be used by the permittee.
- Provisions for the maintenance by the permittee of the sanitation, cleanliness, and appearance of the facility. At times, portable restrooms may be required for special events.
- Provisions for security and the maintenance of law and order, including compliance with noise, parking, safety, and other appropriate regulations. It is at the city's discretion to require security on the premises to enforce the policies of field use. If security is deemed necessary, it is the responsibility of the user group or individual to obtain security personnel at the user's expense. A letter of confirmation from the security agency must be submitted prior to field approval.
- Restrictions on the installation of apparatus or modification in any manner, either temporary or permanent, by the permittee to the sports field or adjacent structures.
- Provisions for the posting liability insurance by the permittee.
