Become a Contract Instructor

Thank you for your interest in becoming a contract instructor for the City of Laguna Beach. The City of Laguna Beach Recreation Division continuously looks for programs that are innovative and promote physical & emotional wellness within our community. If you are interested in proposing a program idea that supports our efforts in providing excellent community services, please submit your proposal using the form below.

Class proposals will be reviewed for program content, benefit to our customers, and cost. Once we receive and review completed proposals, we will contact you with information on next steps. There are no guarantees that your submittal(s) will be accepted by the City of Laguna Beach. 

We will consider applications for classes not currently offered in the City of Laguna Beach Recreation program, so please look through our brochure to see what we already offer.

We are not accepting applications in any of the following categories: tennis, pickleball, and soccer. Applications to teach dance, foreign language, music, art, or fitness classes are welcomed. 

Why do I need to sign a contract to teach my class?

WHY DO I NEED TO BE A CONTRACT INSTRUCTOR?

LBMC 18.04.018: Business on City Property  

No person shall in any manner while on city property, including beaches and parks, sell any product or service or engage in any other business or commercial activity without obtaining a business license and the prior written approval of the city manager, or duly authorized representative; provided, however, that this section does not apply to any concession operated under authority granted by the city council, nor to any other activity specifically authorized, regulated, or exempted by order or resolution of the city council.

For purposes of this section, the word "business" means and includes "business," "profession," "trade," "calling," "occupation," "show," "exhibition" or "game," and all and every kind of calling carried on for profit or livelihood whether or not a profit or livelihood is actually earned thereby and whether or not said business has a fixed place of business in the city.

 

WHY DO I NEED A BUSINESS LICENSE?

LBMC 5.08.200: License Required    

It is unlawful for any person, whether as principal or agent, clerk or employee, either for him or herself or for any other person, or for any body corporate, or as an officer of any corporation, or otherwise, to commence or carry on any business, profession, trade, calling, occupation, show, exhibition or game, in this chapter specified, in this city, without first having procured a license from the city so to do, or without complying with any and all regulations of such business, profession, trade, calling, occupation, show, exhibition or game, contained in this chapter.

 

WHAT IF MY CLASS IS “DONATION BASED?”

LBMC 5.20.020: Charitable Solicitations      

It is unlawful to solicit contributions for any charitable purpose within the city without a permit from the city manager authorizing such solicitation; provided, however, that the provisions of this section shall not apply to any person organized and operated wholly or partially for charitable purposes and not operated for the pecuniary profit of any person if the solicitations by such person are conducted only among the members thereof by other members or officers thereof, voluntarily and without remuneration for making such solicitations, or if the solicitations are in the form of collections or contributions at the regular assemblies or meetings of any such person; provided, further, that when a permit has been issued to any person as defined in Section 5.20.010, other than an individual, then the individual agents and solicitors for such person shall not be required to obtain individual permits.

 

WHAT ABOUT MY SPORTS TEAM’S PRACTICE?

LBMC 18.28.025: Organized Play – Permit Required                 

No person shall participate in any organized play on any park, soccer field, baseball field, tennis/pickleball courts, sand volleyball court, pool or other recreational facility owned, operated, or controlled by the city without first receiving a permit issued by the city which authorizes the organized play at the particular site.

In determining whether or not to issue a permit, the city manager, or designee, shall consider the following and any other factors he or she deems relevant:

  1. The suitability of the particular facility for the proposed play.
  2. The effect of the activity on the neighborhood.
  3. The limitation on the availability of the facility for spontaneous recreational use by the public caused by the permitted use of the facility.
  4. Priority shall be given to groups composed of residents of the city.

The city manager, or designee, may place reasonable conditions on the issuance of a permit as he or she deems necessary and proper to protect the public welfare, including, but not limited to:

  1. Restrictions on the number, age and other designations of persons who may participate in such permitted play.
  2. Restrictions on the season, days of the week and time of day that the particular facility may be used by the permittee.
  3. Provisions for the maintenance by the permittee of the sanitation, cleanliness, and appearance of the facility. At times, portable restrooms may be required for special events.
  4. Provisions for security and the maintenance of law and order, including compliance with noise, parking, safety, and other appropriate regulations. It is at the city's discretion to require security on the premises to enforce the policies of field use. If security is deemed necessary, it is the responsibility of the user group or individual to obtain security personnel at the user's expense. A letter of confirmation from the security agency must be submitted prior to field approval.
  5. Restrictions on the installation of apparatus or modification in any manner, either temporary or permanent, by the permittee to the sports field or adjacent structures.
  6. Provisions for the posting liability insurance by the permittee.
How is a contract instructor different from a City Employee?

A contract instructor is an independent contractor for the city, not an employee. A contract instructor signs a contract with the City to provide classes as described in a submitted proposal. Instructors do not rent our facilities, however a portion of the fees collected are retained by the City to cover facility usage, registration, administration, and promotion of your class in the City's activity guide, newsletter, and other marketing materials.

Schedules

Contractor sets class schedules (with the approval of the City dependent upon facility availability).

Employees are told when and where to work.

Course Content

Contractor develops and sets course content.

Employees are told how to work or use set lessons plans.

Course Materials

Contractor provides all course materials and supplies or charges a material fee to participants.

The City supplies all necessary work materials.

Payment

Contractor splits base revenue with the City.

Employees are paid by the hour.

Tax Liability

Contractor is responsible for taxes and receives a 1099 at the end of the year.

Applicable taxes are paid by the City, and the Employee receives a W-2 at year end.


How often are new classes considered?

The City of Laguna Beach operates on a quarterly schedule. Holiday closures are observed for New Year's Day, Martin Luther King Jr Day, Presidents' Day, Memorial Day, Juneteenth, Independence Day, Labor Day, Thanksgiving and Black Friday, and an annual holiday closure from Christmas Day to New Year's Day. Additional blackout dates will be provided for any special events prior to each program period.

What compensation do contract instructors receive?

Contractors share a 65/35% split of revenue with the City. The 35% retained by the City covers the use of the facility and staff time for administering the program and processing registrations.

How are course fees determined?
The course fee is set by the instructor; however, City staff will make recommendations based on best practices, experience, and marketing trends to meet the City’s goal of offering quality and affordable classes and programs to Laguna Beach residents.
Who processes registrations?
The City is responsible for processing all registration and for the collection of course fees. The contractor is responsible for the collection of supplies/material fees as defined by the course description.
When will a contract instructor be paid?
Payment is determined by the contract terms. For classes one month or shorter, a full payment will be issued at the end of the session. For classes longer than one month, contract instructors may opt to receive an installment at the start of the session with the remaining amount paid at the end of the session. Payments take between 2-3 weeks to process. 
What requirements must be met prior to finalization of an instructor contract with the City?

Before the start of the class session, contract instructors must: 

  • Obtain City of Laguna Beach business license
  • Background check and fingerprinting for all staff and volunteers (current cost of $36 per person)
  • Obtain general liability with additional insured endorsement, primary/noncontributory language, and waiver of subrogation ($1M occurrence, $2M aggregate)
  • CPR/AED certification for all staff
  • Submit a valid W-9 for accounts payable vendor setup
